Washington, D.C. — Former FBI Director James Comey has been formally indicted by the U.S. Department of Justice over a controversial Instagram post featuring seashells arranged to display the numbers “8647,” which federal prosecutors allege constituted a veiled threat against President Donald Trump.
The two-count indictment, issued by a federal grand jury in the Eastern District of North Carolina, claims that a reasonable observer could interpret the image as a “serious expression of intent to cause harm” to the president. Comey owns a beach property in the state, where the photo was reportedly taken and shared.
Controversial Social Media Post at Center of Case
The case stems from a post made in May 2025 in which Comey shared a beach photograph showing shells forming the sequence “86 47.” The term “86” is commonly used in restaurant slang to indicate that an item is unavailable, but it can also mean “remove” or “get rid of” in informal usage.
Trump allies quickly interpreted the combination as a coded message directed at the 47th U.S. president, Donald Trump, prompting an investigation by the Department of Homeland Security and questioning by the Secret Service.
Comey later deleted the post, stating that he had no awareness it could be interpreted as violent. In follow-up comments, he explained that he initially viewed the arrangement as a political or symbolic message found during a beach walk, not a threat.
He also publicly reiterated that he strongly opposes violence in any form.
DOJ Says Post Could Be Seen as Threat
According to the indictment, prosecutors argue that the post could reasonably be perceived as an implicit threat against the president, even without explicit wording.
Acting Attorney General Todd Blanche confirmed that investigators had conducted a “tremendous amount of inquiry” into the matter. However, he declined to present specific evidence regarding Comey’s intent, which is a key requirement for proving the charge.
Blanche noted that intent in such cases is typically established through documents, witness testimony, and broader investigative findings, but said it was too early to discuss trial strategy or whether Comey would testify.
Comey Responds, Denies Allegations
Following the indictment, Comey released a video statement strongly denying any wrongdoing. He described the case as politically motivated and reaffirmed his confidence in the judicial system.
“This is about a picture of seashells on a beach,” Comey said, adding that the situation reflects broader concerns about the independence of the justice system.
His attorney, Patrick Fitzgerald, also rejected the charges, stating that Comey “vigorously denies the allegations” and intends to challenge the case in court. Fitzgerald emphasized that the defense will focus on First Amendment protections and the absence of criminal intent.
Arrest Discussions Underway
While an arrest warrant has been issued, senior law enforcement officials indicated that Comey is expected to voluntarily surrender to authorities in North Carolina. No plans for a public arrest operation have been announced, and officials said he is not expected to be taken into custody in a public setting.
Political Backdrop and Previous Legal Challenges
The indictment adds another chapter to the long-running tensions between Comey and the Trump administration. Trump dismissed Comey from his role as FBI director in 2017, a decision that later contributed to the appointment of Special Counsel Robert Mueller to investigate Russian interference in the 2016 election.
Comey has previously faced legal scrutiny. A separate case involving allegations of false statements to Congress was dismissed earlier after a court ruled that the prosecutor involved had been unlawfully appointed.
The current case was also preceded by political pressure, with Trump publicly urging officials to pursue legal action against Comey and other political figures.
Debate Over Intent and Free Speech
Legal experts note that the central issue in the case will likely be whether Comey’s post can reasonably be interpreted as a criminal threat or whether it falls under protected speech.
Prosecutors must prove that the former FBI director “knowingly and willfully” intended to issue a threat, a standard that is often difficult to meet in cases involving ambiguous online content.
The outcome is expected to have wider implications for how symbolic or interpretive social media posts are treated under federal law.
