Authorities argue that the term “86” is sometimes used as slang implying harm or removal, while critics of the case say the interpretation is politically motivated and lacks context.

Comey has declined to discuss the specifics of the allegation due to ongoing legal proceedings.

Dispute Over Meaning and Intent

The case has sparked disagreement over the meaning of the phrase. Administration officials have argued that “86” can imply violent intent in certain contexts, while others—including workers in the hospitality industry—have long used it as informal slang meaning an item is unavailable or removed from service.

Acting Attorney General Todd Blanche said the indictment is based on more than just the Instagram post, pointing to a broader body of evidence collected over an extended investigation.
