SEOUL — Impeached former South Korean President Yoon Suk Yeol faces a landmark court ruling Thursday in his insurrection trial over his brief but explosive 2024 martial law declaration.
A three-judge panel at the Seoul Central District Court is set to deliver the verdict in a case that has shaken one of Asia’s most established democracies. Security has been tightened around the courthouse amid expectations of large crowds and nationwide live coverage.
If convicted of insurrection — the most serious charge against him — Yoon, 65, could face life imprisonment or the death penalty. Prosecutors have requested capital punishment.
Martial Law Decree Sparked Political Crisis
The case stems from Yoon’s late-night televised address in December 2024, when he declared martial law, suspended civilian governance and banned political activity. It marked South Korea’s first such order in more than four decades.
Yoon justified the move by accusing opposition lawmakers of paralyzing the government through budget cuts and impeachment efforts. However, lawmakers forced their way into the National Assembly during dramatic overnight scenes and unanimously voted to overturn the decree. The order was lifted roughly six hours after it was imposed.
Days later, lawmakers impeached Yoon. In April 2025, the Constitutional Court of Korea upheld the impeachment, formally removing him from office.
Criminal Charges and Broader Legal Troubles
Yoon has pleaded not guilty to insurrection and maintains that he acted within his constitutional authority. Prosecutors argue the order was a calculated attempt to consolidate power and undermine democratic institutions.
In addition to the insurrection charge, Yoon faces multiple criminal trials tied to the martial law episode and other allegations. Last month, he was sentenced to five years in prison in a separate case and is currently appealing.
Seven former military and police officials are also awaiting verdicts for their alleged roles in enforcing the decree, including former Defense Minister Kim Yong-hyun. Prosecutors have sought prison terms ranging from 10 years to life.
Other senior figures from Yoon’s administration have already received lengthy sentences. Former Prime Minister Han Duck-soo was sentenced to 23 years, and former Interior Minister Lee Sang-min received seven years. All verdicts remain subject to appeal.
Deep Political Divisions
The crisis exposed sharp political divides within South Korea. Supporters of Yoon rallied behind him during impeachment proceedings, while critics viewed the martial law order as an unprecedented assault on democratic norms.
South Korea, officially the Republic of Korea, transitioned from decades of authoritarian rule to a vibrant democracy in the late 20th century. The 2024 episode reignited painful historical memories for many citizens.
The country is now led by President Lee Jae Myung of the liberal Democratic Party, elected in June. Ahead of the ruling, Lee praised the public’s resistance to the martial law order, calling South Korea “a model for human history.”
